Long-term Care
Elder law is a delicate balance. You want
the assurance that you’re protecting your assets while planning
for your own needs as well as your family’s financial future.
Services are applicable to those in need
of immediate care, to those adult children who are involved with
the care of older parents, or to those who want to begin planning
to preserve their assets. We also consider the financial needs
of the spouse and/or the family of the senior who remains at home.
In planning for long-term care, we review
personal asset ownership and distribution patterns. Our attorneys
work with the ever changing Social Security, Medicare, and Medicaid
regulations and offer services that include long-term care planning
as well as assistance in the Medicaid application process with
the Department of Health.
Asset preservation
You will make important decisions and may
want assistance with tough choices. We have the legal knowledge
to help you and your family preserve hard-earned assets. We also
will consider appropriate investment, tax, and transfer strategies,
which must be coordinated with respect to long-term care options.
The strength of legal knowledge

of the attorneys and the founding partners, Walter T. Burke and
Timothy E. Casserly, are known for their experience in Elder Law.
Walter is the former Chair of the New York State Bar Association’s
Elder Law Section and is proud to serve on the Executive Committee
of the American Bar Association Senior Lawyers Division. Walter
is also Chair of its Elder Law and Long-Term Care Committee.
Tim combines a practice of law and financial
planning. A CFP® (Certified Financial Planner) designee, Tim
is a past president of the Capital District chapter of the Financial
Planning Association. His strong financial experience is one reason
the College for Financial Planning in Denver, Colorado, has made
Tim’s lectures on Planning for the Elderly available on tape.
A proficient communicator, Tim is the associate editor of the NYS
Bar Association’s two-volume set on Guardianship Practice
in New York.
Attorneys in our office are also members
of the Elder Law Sections of the New York State and Albany County
Bar Associations, as well as the National Academy of Elder Law
Attorneys. The Elder Law Sections examine current issues in Elder
Law, address future legislation, and participate in community educational
programs.

Elder Law: We wrote the book. Walter T. Burke,
Esq., Timothy E. Casserly, Robert Abrams, Esq., and Barbara Nodiff,
R.N., co-authored the consumer planning guide Boomer Basics: Everything
You Need to Know About the Issues Facing You, Your Children, and
Your Parents published by McGraw Hill. Boomer Basics is a layperson’s
comprehensive resource guide to personal, financial, and health
issues, as they relate to the Baby Boomer generation, their children,
and their parents. The book is available in bookstores nationwide,
as well as on Amazon.com and other on-line booksellers.
